We turned out for our friend and advocate commrade Candie Hailey this week 3.21.16, the first day of Spring. What a beautiful day at the Bronx Supreme Criminal Courthouse. Candie was accused of behavioral crimes allegedly committed while she was locked in solitary confinement for almost three years awaiting trial for a crime she did not commit. She was accused of a felony for allegedly breaking government property: a body scanning chair. Candie beat the bum wrap. The RIKERS corrections Captain accusing her (Captain Maloney) contradicted herself so many times [lied] outright and was caught in her double-talk when video of the solitary wing was played-back proving no one took the cuffs, shackles and mittens off Candie when she was in the body scanning room alone.
So the venerable and kind Hon. Judge Mogulescu after hearing a morning of perjurous testimony had enough. After lunch recess he pulled the ADA running the case aside and “recommended” the People drop the charges from one felony and three misdemeanors to four non-criminal disorderly conduct violations. The captain, Maloney, just trashed her career and reputation and has made a lasting impression on the new Bronx District Attorney, Darcel Clark. Its doubtful she will allow further prosecutions against detainees and incarcerates of Rikers unless the CO’s have their stories straight. Let’s hope Captian Maloney’s swiss-cheese testimony has made a lasting impression on the new BX DA. Captain Maloney literally tortured Candie for years: sweet justice has hopefully permanently damaged her credibility.
